Article 14

1. All persons shall be equal before the courts and tribunals（裁判）. In the determination of any criminal charge against him, or of his rights and obligations（义务） in a suit（起诉） at law, everyone shall be entitled to（给……权利） a fair and public hearing（审判） by a competent（合格的）, independent（独立的） and impartial（公正的，不偏不倚的） tribunal（法庭） established by law. The press and the public may be excluded from all or part of a trial for reasons of morals, public order (ordre public) or national security in a democratic society, or when the interest of the private lives of the parties so requires, or to the extent strictly necessary in the opinion of the court in special circumstances where publicity would prejudice the interests of justice; but any judgement rendered in a criminal case or in a suit at law shall be made public except where the interest of juvenile persons otherwise requires or the proceedings concern matrimonial disputes or the guardianship of children.

2. Everyone charged with a criminal offence shall have the right to be presumed innocent until proved guilty according to law.

3. In the determination of any criminal charge against him, everyone shall be entitled to the following minimum guarantees, in full equality:

(a) To be informed promptly and in detail in a language which he understands of the nature and cause of the charge against him;

(b) To have adequate time and facilities for the preparation of his defence and to communicate with counsel of his own choosing;

（己）如他不懂或不会说法庭上所用的语言，能免费获得译员的援助；

（庚）不被强迫作不利于他自己的证言或强迫承认犯罪。

四、对少年的案件，在程序上应考虑到他们的年龄和帮助他们重新做人的需要。

五、凡被判定有罪者，应有权由一个较高级法庭对其定罪及刑罚依法进行复审。

六、在一人按照最后决定已被判定犯刑事罪而其后根据新的或新发现的事实确实表明发生误审，他的定罪被推翻或被赦免的情况下，因这种定罪而受刑罚的人应依法得到赔偿，除非经证明当时不知道的事实的未被及时揭露完全是或部分是由于他自己的缘故。

七、任何人已依一国的法律及刑事程序被最后定罪或宣告无罪者，不得就同一罪名再予审判或惩罚。
